Adelusi v HM Prison Service - ET decision not perverse [2007] EAT

Mr Adelusi lost an unfair dismissal claim. He had joined the prison service in 1994 and was promoted to "senior officer" in 2004. Shortly afterwards he was dismissed after an investigation substantiated an allegation that he had assualted a prisoner. He appealed to the EAT on the basis that the investigation had not been sufficient and that the tribunal's decision was perverse.

The EAT has dismissed his appeal. Dismissal was within the range of reasonable responses open to the employer after conducting its investigation.
