Advance Security UK Ltd v Musa - Discriminatory conduct is unreasonable but unreasonable conduct is not necessarily discriminatory [2008] EAT
When Advance Security refused to recruit Mr Musa, ostensibly on the ground that his passport appeared slightly defective, an employment tribunal concluded that the real reason was that he was of Middle-Eastern Arab origin. Advance appealed against the finding of race discrimination which followed from this.
