Agnew & others v N. Lanarkshire Council - Collective agreements  EAT
Employees who have a collective agreement incorporated into their contracts of employment are bound by the terms of the agreement.
Approximately 250 employees, including Mr Agnew, presented claims at Glasgow Employment Tribunal for unlawful deductions from wages by their local authority employer North Lanarkshire Council. These claims stemmed from the imposition of a new pay structure for local authority employees that was undertaken in accordance with a collective agreement. Mr Agnew and others contended that the new terms and conditions had been introduced without their agreement and resulted in an unwarranted diminuition of pay.
