Ahari v Birmingham Heartlands & Solihull Hospitals NHS Trust - Absolute immunity attaches to witnesses giving evidence before Fitness to Practice Panel, a quasi-judicial body [2008] EAT

Dr Ahari, an anaesthetist, resigned form the Trust in April 2000. On 12th May 2006 he presented a claim of race discrimination to an employment tribunal. The last possible act of (post-employment) discrimination took place in 2002, but Dr Ahari argued that there was continuing discrimination and that this meant his claim was "in time". For this he relied on evidence given to a Fitness to Practice Panel (FPP) by the Trust's Clinical Director on 22 & 25 May 2006 - ie after the date of his ET1 claim form to the tribunal. The tribunal rejected the claim as (seriously) out of time.
