Airbus UK Ltd v Webb - Expired disciplinary warnings [2007] EAT
A disciplinary warning is frequently stated to be for a specific time, rather like points endorsed on a driving licence. This case is authority for the fact that, just as a magistrates court considering whether to disqualify a driver cannot take account of expired points, an employment tribunal "is obliged, and not merely entitled, to ignore expired warnings" . In this case five employees committed offences but only one of them, Mr Webb, was dismissed. He had been "guilty" of a similar offence in the past and had been given a final written warning.
