Akanu-Otu v Secretary of State for Justice - deposit order not defective

An Appeal sought to show that a deposit order had not been sufficiently explicit as to the power to strike out the case if it was not complied with.

The claim was of race discrimination in the Prison Service where Miss Akanu-Otu had worked as a nurse and it arose after a failure to pay a deposit required by a Deposit Order. As a result, the claim was struck out and the appeal came before Mr Recorder Luba QC.

Miss Akanu-Otu appealed on the basis that the DO had not stated on the face of it that the sanction for non-payment would be strike out.
