Akintola v Capita Symonds Ltd [2009] EAT

Health and safety whistleblowing and constructive dismissal appeal fails.

Mr Akintola is an engineer. He refused to go down a manhole to report on issues relating to London Underground on the basis that it was unsafe for him to do so. He had raised a number of complaints about other incidents and in due course resigned, claiming that he had been constructively dismissed
