Alemo-Herron & Others v Parkwood Leisure Ltd - TUPE and collective agreements
Where an employee's employment has been transferred to a new employer after a TUPE transfer and his or her terms of employment incorporate terms of a collective agreement, the transferee employer must give effect to a pay increase agreed under that collective agreement by the transferor even though the pay increase was agreed after the TUPE transfer has taken place.
CAUTION: this EAT decision was later overruled by the Court of Appeal on 20th January 2010
