Alstom Transport Ltd v Tilson - Finding of "bogus" contract went beyond tribunal's jurisdiction [2009] EAT

The question in this case was whether an employment relationship existed. An employment judge concluded that a contract was a sham when that point had not been raised, and was not a live issue before him. Doing so was an error of law since he went beyond his jurisdiction, which is to make decisions on issues which are put before him or her by the parties.
