Alstom Transport v Tilson - Prejudging matters inevitably creates appearance of bias on part of Chairman [2007] EAT
Mr Tilson claimed unfair dismissal against Alstom. An employment tribunal chairman refused Alstom's application to join two further parties to the proceedings. When giving his reasons the Chairman expressed firm views on issues which were then before him in a pre-hearing review (PHR) which he had, at that stage, only part-heard. Alstom appealed the "joinder decision" and claimed that the PHR had been pre-judged.
