Amey Services Ltd v Cardigan & ors - Employer's defence not required in equal pay case until prima facie claim made out [2007] EAT
Mrs Cardigan, Mrs Marr and others submitted Equal Pay Act claims against Edinburgh Council and, where work had been contracted out, Amey. None of the claim forms identified a comparator. At the outset the employment tribunal ordered Edinburgh and Amey to provide written explanations for any difference in pay. Edinburgh and Amey appealed.
