Andrews v Kings College Hospital NHS Foundation Trust & Anor - Justifying late submission of contract claim [2012] EAT

Reliance on the advice given by the employer's head of pensions and payroll, someone put forward by the employer as a person of some authority, provided sufficient justification for late presentation of a breach of contract claim. 

Mrs Andrews was employed part time by the Trust from 1982 as a clinical nurse specialist. During her employment the rules for joining the statutory pension scheme changed. From March 1988 the pension scheme was compulsory for full‑time employees; part‑time employees were excluded (period 1). From 1 April 1988 to March 1991 the scheme was optional for full‑time employees but part‑time employees were excluded (period 2). From 1 April 1991 to December 2005, membership of the pension scheme was optional for both full‑time and part‑time employees (period 3).
