Aptuit (Edinburgh) Ltd v Kennedy - Tribunal chairman must not prosecute an unrepresented party's case  EAT
Mrs Kennedy was made redundant by Aptuit Ltd, and claimed unfair dismissal. She represented herself at the employment tribunal. Although it was not a matter Mrs Kennedy had raised anywhere, the Chairman suspected very early on that she had been given no right to appeal. Without clearly expressing his concerns, the Chairman asked some questions about any appeal. The tribunal then went on to find that the lack of appeal was a breach of the statutory procedures, and made the dismissal automatically unfair.
