Arqiva Ltd v. Sagoo - Disclosure [2007] EAT

Mr Sagoo brought claims of unfair dismissal and unlawful treatment on grounds of race and/or religious belief against his former employer, Arqiva Ltd. However, during proceedings, an issue arose regarding the disclosure of a document which contained evidence given by a former colleague of Mr Sagoo. The employers did not want to disclose it, but the tribunal chairman decided that it should be disclosed. Arqiva appealed on this point. The EAT has allowed the appeal and remitted the case back to the original tribunal.
