Arriva Scotland West Ltd v Porter - Level of investigation in misconduct dismissal case must accord with what reasonable employer would do in the circumstances [2008] EAT
Mr Porter was dismissed following an altercation with fellow employee Mr McNamara - who was not. An employment tribunal criticised Arriva's procedures and held that the dismissal was unfair. Arriva appealed and has won to the extent that the case has been remitted for rehearing.
