Aryeetey v Tuntum Housing Association - Mistake by Chairman is proper ground for extension of time limits [2007] EAT
Mr Aryeetey, an accountant, was dismissed after raising concerns about certain practices within the Housing Association. He complained of automatic unfair dismissal and detriment short of dismissal - based on "whistleblowing". The tribunal originally rejected the detriment element of the claim, since Mr Aryeetey had not submitted a grievance. After he had done so a tribunal chairman specifically advised that he need not present a new claim. A second chairman disagreed - and allowed him to present a new claim out of time. Tuntum appealed.
The EAT dismissed the appeal.
