Asda Stores Ltd v Kauser - Stress of police investigation no excuse for missing unfair dismissal claim time limit [2007] EAT

Asda dismissed Mrs Kauser, suspecting her of theft from the tills, on 22 June 2006. Mrs Kauser was then arrested. On 19 September police told her that they would take no action against her. She presented an unfair dismissal claim on 10 October. The employment tribunal allowed her claim, despite it being out of time - she was very stressed and, although she always intended to bring such a claim, she said she believed she could not do so while the police investigation was ongoing. Asda appealed.
