Ashton Seals Ltd v Mate - Role of the Employment Appeal Tribunal is to hear appeals on the law, not fresh arguments on the facts [2007] EAT
Mr Mate was dismissed. He won at an employment tribunal in claims for notice and holiday pay, and lost his claim for a bonus payment. Both parties appealed. The EAT dismissed all the appeals - "I can see nothing wrong with the way in which the Chairman approached this issue. He heard the evidence; he heard the witnesses: the conclusion he drew was one which he was entitled to draw" said HHJ Birtles.
