Asif v Key People Ltd - Worker's breach of contract cannot be used as defence to a claim for unlawful deduction of wages [2008] EAT
Key, an agency, contracted with Mr Asif that he would work for five months for a client in Paris. After two days work Mr Asif returned home - the client would not pay for his accommodation as he claimed to have understood it would. Key refused to pay him for the two days' work - it said that there had been no agreement to pay for accommodation. Mr Asif claimed this was unlawful deduction of wages.
