Aslam v Barclays Capital Services & Others - Credibility issues made review by tribunal inappropriate way to deal with fresh evidence [2011] EAT
When fresh evidence emerges that could impact on a tribunal's findings and the fairness of a hearing, this is usually best dealt with by way of review: however there will be situations, particularly where careful scrutiny of the evidence will affect a tribunal's findings on credibility, that a review cannot be seen to remedy the unfairness. In such circumstances only an appeal followed by a rehearing can rectify the situation.
