ASLEF v Brady - unfair dismissal finding stands

ASLEF appealed against the London Central tribunal's finding that it had unfairly dismissed its General Secretary, Mr Brady.  ASLEF lost.

The EAT ruling shows that an employee whose misconduct has been sufficiently serious to merit dismissal may still be entitled to claim for unfair dismissal if he can show that the true reason for the dismissal was in fact his employer's antagonism towards him.
