Asserting a Statutory Right
- Dismissal is automatically unfair if the principal or sole reason for dismissal is that the employee has asserted a relevant statutory right.
- The employee does not have to have brought proceedings for infringement of the statutory right; it is sufficient that the employee has alleged that the relevant statutory right has been infringed.
