B v A - Unfair dismissal and CRO enhanced disclosures [2007] EAT
The EAT has overruled an employment tribunal which had found that A had been unfairly dismissed by B, a childrens charity providing care services to vulnerable young people. The importance of the decision is that it establishes that if an employer with responsibility for vulnerable children or adults becomes aware of facts which lead it to lose 100% confidence in an employee and (after due process) dismisses him or her, the fact that the employer does not investigate further will not of itself make the dismissal unfair.
