Baldwin v Brighton & Hove City Council - proper formulation of the implied term of trust and confidence - EAT 14.12.09

An employment tribunal at Brighton dismissed claims of sex discrimination and constructive unfair dismissal by BHCC's fomer Lesbian, Gay and Bisexual Community Safety Development Officer. Unusually, though irrelevant from a legal point of view, the person concerned, Andy Baldwin, was a female to male transsexual whose partner was a male to female transsexual. The EAT has dismissed his appeal.
