Ballots
- A Trade Union’s statutory immunity from liability for inducing breach of contract when calling on members to come out on strike or to take other industrial action depends on the Trade Union having the support of a ballot and complying with other specific statutory requirements Trade Union and Labour Relations (Consolidation) Act 1992 (“TULRCA”) s.226(1).
- It is important to note that the Trade Union Act 2016 (“TUA”) introduced various changes to this area, which trade unions need to follow in order to receive immunity from liability relating to industrial action
