Baraheni v Royal Berkshire NHS Foundation Trust - Disproportionate disclosure requests and allegations of fraud [2011] EAT
Allegations of forgery about disclosed documents are very serious: they must be very carefully made and supported by proper details. To seek electronic disclosure of some 5000 documents which have already been disclosed on paper, based simply on a vague and general claim that the Claimant does not trust they are genuine, is an unreasonable and disproportionate disclosure request, and will certainly not be ordered by a tribunal.
