An appellant need not exhaust all avenues of appeal with the EAT before seeking to appeal to the Court of Appeal. However, if permission is refused there, and he opts to once more pursue his appeal in the EAT, the EAT's time limits will have kept running in the meantime: the appellant's choice to go elsewhere will not be a ground for extension of time.
