Barrosso & ors. v Fahy - Response to a claim out of time because of delay in the post [2007] EAT

Mr Barrosso (and others) faced a claim of sexual harassment by a work colleague, Ms Fahy. Extended time for their responses to her claim expired on 24th November 2005. On 23rd November, Russell Jones & Walker, their solicitors, sent their responses to the Tribunal by first class post. The documents were not delivered until 30th November. The tribunal entered judgment in default, on liability only. Mr Barrosso and the others applied for review of this decision. The application was refused . The EAT has now reversed this.
