Bass v Travis Perkins Trading Company Ltd - Constructive dismissal, errors concerning repudiatory breach [2005] EAT
Mr Bass resigned from his job some time after complaining of ill treatment and race discrimination. A tribunal rejected his claim that he had been constructively dismissed firstly because the breaches in respect of which he resigned were only partially the reason for his resignation and secondly because "he has delayed so long in resigning that he must be deemed to have waived the breach". The EAT allowed his appeal.
