Bedfordshire County Council v Eaton - Did a tribunal substitute its own view for that of employer in an unfair dismissal case [2006] EAT
Mr Eaton, a children's home manager, won £40,777 compensation for unfair dismissal in a case he brought against Bedfordshire CC (amongst other allegations he had left children unattended in a car while he visited a friend in hospital). Bedfordshire CC appealed to the EAT, arguing that the tribunal had substituted its own view for that of the employer rather than applying the correct test of whether dismissal was within the range of responses responses open to a reasonable employer. The EAT dismissed the appeal.
