Benjamin v Interlacing Ribbon Ltd - Sick pay entitlement [2005] EAT
An employment tribunal applied the wrong tests in considering whether an employee was entitled to sick pay when there was nothing in writing. Although the claim was not for sick pay (it concerned constructive dismissal) the sick pay issue was central to it. The case was remitted back for the Tribunal to consider the issue of sick pay afresh and how its finding on that fed in to the question of constructive dismissal.
