Benviste v Kingston University - Victimisation and protected acts [2007] EAT

Dr Benveniste was dismissed because she failed to comply with what the Univeristy claimed was a reasonable management instruction. There was no express suggestion by the University that she had been guilty of gross misconduct. Pending a full hearing of her claims for unfair dismissal, breach of contract and victimisation, she appealed against certain decisions emerging from a case management conference.
