The threshold set for a perversity appeal is a high one
Mr Bird was employed at the age of 65 as a contracts engineer for the University of Bristol. He brought a claim of unfair dismissal, arguing that although his offer letter made no reference to any minimum period of employment, it was orally agreed at the interview that he would be employed for a minimum of five years. It was not argued that the agreement was made in writing or made after the interview.
