Birmingham City Council v Akhtar & Others - equal pay and the "same source" for terms and conditions

Female Council workers employed in schools could compare themselves to male Council workers employed elsewhere because they were "in the same employment". Both had the same employer (the Council) and both were employed at establishments where common terms and conditions were observed; the fact that, theoretically, school governors could enforce different terms was insufficient to alter the fact that - in reality - the Council was the source of the terms and conditions of both groups.
