Bisset v Martins & anor - Vicarious Liablity and "grievance procedure" extension of time limits [2006] EAT Scotland
The interesting feature of this case is that the EAT decided that the 3 month "grievance procedure" automatic extension to the time allowed for lodging a tribunal claim (under Employment Act 2002 (Dispute Resolution) Regulations 2004 SI 2004/752 reg 15) applies to vicarious liablity claims against an employer but does not apply to a claim on the same facts brought against a fellow employee for whose action the employer is vicariously liable.
