Bournemouth Borough Council v Leadbeater - extension of time request in application to set aside default judgment can be implied

An application to set aside a default judgment must include an application for an extension of time to lodge a response. However, that application need not be expressly made: the requirement is met if the tribunal can "discern" a request to extend time from the application.
