Bowen v Millbank Estate Management Organisation - unfair disciplinary procedure - EAT 23.3.07

Ms Bowen claimed automatic unfair dismissal on the grounds of an unfair discplinary procedure. The tribunal acknowledged that Step 2 of Schedule 2 to the Employment Act 2002 had not been followed, but stated that s.98A of the ERA did not apply, and that dismissal was therefore not automatically unfair. The EAT have allowed an appeal, stating that s.98A of the ERA did indeed apply in this case.
