Bridal Fashions Ltd v Burke - decision to resign must be communicated to employer

Ms Burke worked for Bridal Fashions Ltd in their store in Bath Street, Glasgow.  She went off work due to stress, allegedly caused by her manager, in December 2006. 

She told her doctor that if she returned to work her symptoms would recur .  On that basis, not on any assessment of his own and although she was in fact "fit and symptom free", the doctor continued to issue certificates stating that he diagnosed the claimant as suffering from “stress at work”.

The result was that although Ms Burke knew that she was well throughout 2007, her employer did not know that.
