British Association for Service to the Elderly (1) Duckworth (2) v Lawton - Reasonableness of dismissal is a question of fact for an employment tribunal, to be overturned on appeal only if perverse [2008] EAT

BASE dismissed Mrs Lawton. An employment tribunal found the dismissal to be automatically unfair due to a failure to follow the statutory dismissal procedures as well as substantively unfair. BASE appealed, arguing that the tribunal failed to take into account their precarious financial position and their discovery that Mrs Lawton had taken on outside work without telling them, both of which supported their contention of having "some other substantial reason" for fairly dismissing her.
