British Association for Shooting & Conservation v Cokayne - Dismissal on withdrawal under Rule 25 is absolute bar to second identical claim [2007] EAT
Mr Cokayne resigned from the BASC claiming constructive dismissal relating to his manager's behaviour. BASC responded that internal grievance procedures had not been completed. Mr Cokayne acknowledged this and withdrew his claim, saying he would present a second claim when the grievance was completed. He did so, but by then the tribunal had dismissed the first claim "on withdrawal". A tribunal chairman rejected BASC's argument that the second claim was estopped. BASC appealed.
