British Gas Trading Ltd v Scott - Recurrence of condition before date of discrimination is evidence of likelihood of recurrence [2008] EAT

Mrs Scott suffered a dislocation of her left knee-cap (patella) on two occasions. Between the two dislocations she made a complete recovery. British Gas (BG) dismissed Mrs Scott after her second knee-cap related absence. She claimed disability discrimination. An employment tribunal held that she was disabled within the Disability Discrimination Act 1995. BG appealed.
