Bulling v Dartford Gravesham and Swanley Primary Care Trust - Reasonableness of dismissal [2006] EAT

Mrs Bulling lost an unfair dismissal claim, the Ashford employment tribunal having found that she had been dismissed for misconduct.

She appealed to the EAT, mainly on grounds that her employers had never properly investigated the circumstances. The EAT held that although "it may be surprising that the conclusion of the Tribunal was that this was not an unfair dismissal, it cannot be said that it was outside the band of reasonable responses of an employer to dismiss in these circumstances".

Accordingly her appeal was dismissed.
