Bungay & Ors v Saini & Ors - agency, joint and several liability, and aggravated damages for post-employment conduct

An employment tribunal was fully entitled on the evidence to find that two employees acted as agents of their employer when discriminating against colleagues. It was appropriate that it award damages against them on a joint and several basis without apportionment: this is now established to be the correct approach, and authorities to the contrary should no longer be followed.
