BUPA Care Homes Ltd v Muscolino - Double jurisdiction (ET and Care Standards Tribunal) [2006] EAT

Mrs Muscolino claimed unfair dismissal against BUPA. BUPA sought a stay pending final determination of an assessment under the Care Standards Act 2000 of her suitability to work with vulnerable adults.

The EAT refused BUPA's request.

BUPA woud be adequately protected because the employment tribunal would be able to take all circumstances into account in assessing remedy if the unfair dismissal claim against BUPA succeeded, and would be able if it saw fit to defer a remedies hearing pending the final outcome of the Care Standards Tribunal.
