Burt v UK Sports Centres Ltd - Tribunal was wrong to refuse to hear a claim because the employee failed to send a statutory grievance to a "hard to trace" employer [2008] EAT
Mrs Burt brought tribunal proceedings against Sports Centres Ltd. She completed her ET1 application form in an ambiguous way. Her application was rejected by a tribunal chairman on the basis that the statutory grievance procedures applied to her complaint and although she had explained why she had not sent a written statement of grievance to her employer the explanation did not satisfy Employment Act 2002 (Dispute Resolution) Regulations 2004, reg 6(4).
