Bury Metro Racial Equality Council (1) Luqman (2) Cohen v Lyle (3) - refusal of leave to amend appeal in the EAT - EAT 12.3.08

Mrs Lyle won her disability discrimination claim against the REC and both Mrs Luqman and Mr Cohen. They appealed to the EAT, and their appeal was allowed to proceed on limited grounds. The tribunal had held that the claim was in time.The discrimination against Mrs Lyle was a continuing act right up to presentation of her claim, mainly due to a letter from Mrs Lyle to Mrs Luqman which constituted a statutory grievance. After the EAT's preliminary hearing the appellants sought to amend their appeal to challenge this finding for the first time.
