Butler v G.R. Carr (Essex) Ltd - Amount of uplift in tribunal award when dismissal is automatically unfair because statutory procedures were not followed [2007] EAT
The EAT has held that there was no error of law when an Employment Tribunal applied a 30% uplift to compensation awarded to Mr Butler for unfair dismissal on account of the employer's total failure to follow the statutory dismissal procedures. Mr Butler had appealed, claiming that the uplift should be 50%. The EAT dismissed his appeal.
