Butt v Children & Family Court Advisory & Support Service - "reverse Polkey principle" cannot cure automatically unfair dismissal - EAT 30.11.07

CAFCAS dismissed Mrs Butt, a Family Court Adviser. She claimed disability discrimination and unfair dismissal but an employment tribunal rejected her claims. It found that there was unreasonable delay by CAFCAS in holding an appeal which amounted to a breach of the statutory disciplinary procedures. However CAFCAS demonstrated that the result would have been the same without the unreasonable delay and so the dismissal was held to be fair. Mrs Butt appealed.
