Caldwell Hardware (UK) Ltd v Hooper - revocation of judgment dismissing a claim does not reinstate the claim

The EAT has  ruled that it was wrong in law for an  Employment Tribunal Chairman to have held that the effect of revoking a Judgment dismissing a claim on the application of the employer/respondent (pursuant to Rule 25 (4)) after withdrawal by the claimant (pursuant to Rule 25 (2)) of the 2004 Rules was also to revoke the withdrawal of the claim.
