Camden & Islington Foundation Trust v Boafo - offences in disciplinary procedure are not exhaustive examples of gross misconduct

It is not material that an offence is not included in the disciplinary procedure in order to show gross misconduct

An ET found that Ms Boafa, a nursing assistant with the Trust, was fairly but wrongfully dismissed following a disciplinary matter and awarded 12 weeks pay for loss of notice. Ms Boafo had specialised in older patients, some with dementia, and she was dismissed following an unannounced visit during which she was found asleep on duty.
